Replacing balcony guards on a multi-unit residential or commercial building requires a building permit, because guards are life-safety elements and because replacement means drilling new structural anchors into a slab edge. A genuinely like-for-like repair of a single damaged section — same system, same anchors, same geometry — may be treated as maintenance and slip past the permit requirement. A building-wide replacement never does. The gap between those two situations is where owners get into trouble, usually by hearing the word repair from a contractor who wants to avoid a permit.

    Why guards trigger permits when other exterior work does not

    Municipal building departments care about three things on a balcony guard project, and all three are permit triggers. The guard is a required life-safety barrier, so its height, opening sizes and non-climbable zone are code-regulated. The connection is structural, so the anchors are transferring load into a post-tensioned or conventionally reinforced slab that a plans examiner would like to know is capable of taking them. And the work happens at height on an occupied building, so site safety and public protection come into scope.

    There is also a quiet reason: most balcony guard replacements on buildings from the 1970s through the 1990s are not like-for-like at all, because the original guards do not meet current code. Original heights of 900 mm on exterior balconies, horizontal mid-rails inside the non-climbable zone, and picket gaps over 100 mm are all common on older stock. The moment the new guard has to meet today's requirements, you are doing an alteration, not a repair.

    What a permit package actually contains

    • Stamped structural drawings for the guard system, sealed by a professional engineer licensed in the province where the work is happening
    • Load calculations covering code guard loads plus site-specific wind pressures for the building height and exposure
    • Anchorage details and calculations tied to the actual slab condition — thickness, concrete strength, reinforcement, edge distance
    • Existing conditions documentation, usually including concrete testing or core samples where slab capacity is uncertain
    • Product data: alloy and temper, glass make-up, finish specification, fastener grades
    • Site plan, elevations and a schedule of quantities by balcony type
    • In some jurisdictions, a demolition or partial-demolition component covering removal of the existing system

    The engineering is not a formality you can add afterwards. On an existing building, the anchorage design cannot be finalized until someone has confirmed what is actually in the slab edge, which is why buildings with unclear as-built records need investigation before drawings, and drawings before permits. That sequence is the single largest source of schedule surprise on retrofit projects.

    Quebec and Montreal specifics

    In Quebec, contractors performing this work must hold the appropriate Régie du bâtiment du Québec licence, and the design must satisfy the Quebec Construction Code, which adopts the National Building Code with provincial modifications. Montreal issues permits at the borough level, and balcony guard replacement is typically handled as a transformation permit rather than a simple renovation. Boroughs with heritage character or architectural integration bylaws may also require site planning and architectural integration review, which adds a design-approval step on top of the technical review — and can constrain colour, profile and infill type before engineering even starts.

    Practical advice for Montreal owners: confirm with your borough early whether architectural review applies, because that determines whether you are choosing a finish from an approved palette or choosing freely. It also determines whether your timeline is eight weeks or five months.

    The permit is rarely the hard part. Establishing what is actually inside a thirty-year-old slab edge is the hard part, and no permit gets issued until someone has answered that.

    Ontario, the Atlantic provinces and the condo layer

    Toronto, Ottawa, Halifax and most other Canadian municipalities follow the same basic model: a building permit application supported by sealed drawings, reviewed by a plans examiner, followed by mandatory inspections at defined stages. Coastal municipalities may ask harder questions about corrosion resistance and material selection, which is one reason marine-grade aluminum specifications come up so often on Halifax and Nova Scotia projects.

    For condominiums there is a second approval layer that has nothing to do with the city. Ontario's Condominium Act distinguishes between repairs and maintenance, which a board can simply carry out, and substantial changes to common elements, which can require owner notice and in some cases an owner vote. A guard replacement that changes the appearance of the building — swapping aluminum pickets for glass, for instance — is far more likely to be treated as a change than a like-for-like replacement in the same style. Quebec syndicates face a comparable distinction under their declarations of co-ownership. Boards that skip this step have had projects halted mid-installation.

    How long the approvals take

    For a typical multi-storey residential retrofit in 2026, plan on roughly four to twelve weeks from complete application to permit issuance, with heritage or architectural review adding meaningfully to the upper end. Add time ahead of that for condition assessment and engineering, and add time behind it for fabrication. Because permitting sits at the front of the critical path and fabrication sits behind it, the correct order of operations is to start engineering in the fall for a summer installation — not to start looking for a supplier in April. Railing lead times and their effect on project critical path are worth understanding before you set a completion date with residents.
